DOL Independent Contractor Rule in 2026: Proposal and Current Standards
**Status checked 5 October 2026:** DOL’s official page still identifies the February 2026 action as a proposal, and says its comment period **closed on 28 April 2026**. The NPRM, published 27 February under RIN 1235-AA46, proposes replacing the 2024 FLSA interpretation with a modified 2021-style analysis and using the analysis for FMLA and MSPA. A proposal is not a final rule with an effective date.
