What this flow produces is a summary to check against the real form, and it covers two of them: a W-9 where the payee is a US person, and a W-8BEN where the payee is a foreign individual. An entity uses W-8BEN-E instead, which runs to thirty parts and asks for a chapter 4 status, and that sits outside what this page prepares. A treaty position needs Part II filled in with the country, the article relied on, and a tax number, either a US one on line 5 or the foreign tax identifying number on line 6a. The signed form goes to the withholding agent who asked for it and is not filed with the IRS.
Letting the payer withhold and reclaiming later does work, eventually. The mechanics are worth pricing before choosing it. With no valid form on file the agent withholds 30% from US-source payments of the fixed or determinable kind, reports the amount on Form 1042-S, and sends the money to the Treasury. Getting it back means filing a Form 1040-NR for that year, with a US taxpayer number the payee may first have to apply for, once the 1042-S arrives the following March. On a $20,000 fee that is $6,000 sitting elsewhere for the better part of a year.
A form can go stale inside a vendor record while everyone assumes it is fine. The payee has 30 days to tell the withholding agent once something on it stops being true, and the trigger most often missed is the address. Moving to a US address is a change in circumstances; moving between two foreign countries is not, unless a treaty claim rests on residence in the country being left. The agent needs a valid form at the moment of payment, so a correction that lands after a payment has been released does nothing about the 30% already sent.
